1. What this document covers
1.1 These Terms & Conditions govern the supply of a FARB-GEL Safety Pack (the “Item”) as a guaranteed membership perk to
(a) Master Black Belt members of the Black Belt Barrister YouTube channel and/or
(b) members at an equivalent level on blackbeltbarrister.com (together, “Membership”).
1.2 This perk is not a prize draw or contest and does not require any separate purchase beyond Membership. It is a predictable benefit available to qualifying members while stocks last and subject to these Terms. (YouTube Memberships allow creators to offer physical or digital goods as perks. )
2. Intellectual property notice (FARB-GEL)
2.1 FARB-GEL-SPRAY / FARB-GEL is a brand associated with the TW1000 range. In the United Kingdom, FARB-GEL-SPRAY is a registered trade mark UK00003354934, owned by Carl Hoernecke Chem. Fabrik GmbH & Co. KG. All trade marks, logos and get-up remain the property of their respective owners. We are not the trade-mark owner.
3. Nature of the Item (safety marker; non-noxious)
3.1 The Item is marketed as a criminal-identifier / colour-dye gel intended to mark and disorient an assailant to facilitate escape, not to injure. It does not contain OC, CS, CN or other irritant to our knowledge and is supplied strictly as a non-noxious marker product. (Supplier descriptions indicate FARB-GEL products are positioned as UK-legal, non-irritant identifiers. )
3.2 We do not warrant chemical composition. Further information is available on farbgel.com.
4. Eligibility & acceptance
4.1 Age: Recipients must be 18 years or over and confirm age at checkout (website) or via a web form (YouTube).
4.2 Territory: UK Mainland delivery only (unless we expressly agree otherwise).
4.3 Form & acknowledgement: You must (a) complete the online Perk Acknowledgement & Safety Disclaimer form, and (b) confirm a UK delivery address. Failure to complete these steps may forfeit the perk (no refund of Membership is due on that basis).
5. Safety and lawful use (your responsibilities)
5.1 Use only in emergencies to mark and escape.
5.2 You must use the Item lawfully and responsibly at all times. Misuse may constitute criminal conduct (e.g. assault) or give rise to civil liability.
5.3 Always check and comply with venue, transport and carrier rules (many carriers restrict pressurised containers).
5.4 You agree to indemnify BlackBeltBarrister / ShenSmith Group Ltd against claims, losses or costs arising from your possession, carriage or use of the Item, except to the extent caused by our negligence.
6. Supply, delivery & substitutions
6.1 One Item per qualifying account unless otherwise stated. We may substitute equivalent models if a listed model is unavailable.
6.2 Dispatch timeframes are indicative only. We are not liable for carrier delays, refusal of carriage, or seizure by authorities outside our control.
7. No separate sale; consumer information
7.1 The Item is not sold separately; it is provided as part of the Membership perk bundle. Your consumer rights for Membership remain unaffected.
7.2 If you cancel Membership within any applicable cooling-off period and return the unopened Item (or confirm non-receipt), we may deduct a reasonable amount to reflect costs incurred.
8. Platform compliance (YouTube & website)
8.1 YouTube statement: This perk and any communications about it are not sponsored, endorsed, administered by, or associated with YouTube. YouTube has no responsibility for the Item.
8.2 We do not operate this perk as a contest or lottery; no “chance” element applies; no action such as liking or commenting is required beyond holding the relevant Membership.
8.3 Payment-processor and courier policies may apply to “restricted” or “dangerous” goods. Where a processor or courier refuses service, we may use an alternative method or offer a reasonable substitute.
9. Data protection
9.1 We will process your name, age confirmation, contact details and delivery address to fulfil this perk under UK GDPR and Data Protection Act 2018. See our Privacy Notice for details of retention and your rights.
10. Disclaimers & liability
10.1 Except as required by law, we give no warranty as to fitness of the Item for any purpose. To the fullest extent permitted, we exclude indirect or consequential loss.
10.2 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded.
11. Governing law & contact
11.1 These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
